In San Diego, California, officers are using a new method to test for the presence of DUI marijuana. They are using a mouth swab. This is just another method law enforcement is using trying to determine impairment. Other tests, such as blood tests, have been used in the past. The problem is, just how much THC does it take to be considered impaired?
Controversially, many states are simply throwing up their hands in frustration as there, as of yet, does not seem to be a clear cut method for determining impairment from THC. It is not a "one size fits all" as THC affects everyone differently. Some could have consumed large quantities and have no impairment at all, while others could have "a puff" and be somewhat disabled.
Where does this lead? Currently, many states are considering establishing a limit for blood content of THC, whether there is any impairment or not. What does this tell us? That, as with any substance, do not drive if you have consumed any substance to the point that it could possibly impair your ability to drive, and do not drive at all if you have consumed some particular substances.
