You CAN Fail A Field Sobriety Test - When You Are Sober!
It is important to know your rights when you are questioned by a law enforcement officer. You have the right to remain silent and you have the right not to do anything that could be used against you. This includes taking Field Sobriety Tests.
You might think that "Wow, I am COMPLETELY sober, haven't had a drink in days, no way could I fail this test" so you take it. However, the officer giving you the test clearly believes you are impaired and will most likely see what he wants.
You should know these tests are very unreliable from the start. They are based on observation and if you have any foot, knee, back or balance problems, you may fail the tests to even an unbiased eye.
