A number of interesting developments are likely to occur in the realm of DUI law. In Minnesota, for example, the Supreme Court found that the due process rights of many charged with DUI were violated and will seek to remedy the wrongs. This is perhaps indicative of a trend that police and prosecutors need to be more careful when charging individuals with and gathering evidence for DUIs.
Another development likely to happen in 2017 is a dramatic increase in the number of marijuana DUI charges and convictions. With many states legalizing marijuana and tests becoming more readily available for determining its presence, police are far more likely to be looking for those operating under the influence of marijuana. Of course there is also likely to be debate as to what amount of marijuana actually constitutes impairment.
