What Happens On DUI Probation?
Probation is an action the courts can take when sentencing someone convicted
of a crime, either a misdemeanor or a felony. In the case of a
first DUI offense, the court usually sentences the offender to
unsupervised probation, which means that the offender does not have to
meet with a probation officer. However, the court will "supervise" the
offender anyway through actions the offender must take.
Of course, if you are on probation you cannot have any additional
criminal cases come before the court. This does not include traffic
violations, so if you speed in a non-reckless manner, you will not
violate your probation. Also, you generally cannot have any alcohol in
your system at all. Not even 0.01 can register on a breathalyzer in most
states.
Some additional conditions of DUI probation may include attending a
a court-approved DUI course, paying your fines and fees and submitting to
field sobriety tests and breathalyzers on any traffic stop. If you
complete your probation successfully you may wish to have your attorney
try to seek an expungement of your case.
