Videotaping By Police Does Not Tell All
If you are stopped by the police and suspected of DUI, bodycams, and
dashcams used by the police do not tell the whole story, especially to a
jury. With the advent of videotaping by the police with both body and dash cams,
many people believe that everything on video is certain to
help convict them. Just because you may have had an arrest, interview or
field sobriety tests recorded by the police, does not mean that you
should enter a plea deal without consulting an attorney.
Even though body and dash cams reveal a lot to jury members, there is
plenty that can be contested during cross-examination. For instance,
police almost always say that a suspect had bloodshot eyes or smelled
strongly of alcohol. These are two claims that are not backed up well by
videotaping. The lack of odor is clear, but the look of bloodshot eyes
is often subjective and the body and dash cams rarely have the zoom and
focus to accurately assess the color of one\'s eyes, especially the white
parts.
