The First Question The Officer Asks
If an officer suspects you may be operating under the influence, the very first question he may ask you is "Have you had a few drinks tonight?" Most people do not know their rights and straightaway admit to "having a few." If you are asked this question, and you have had a few, here are some points to keep in mind:
1) Do not give the officer misinformation. If you deny drinking and the officer submits you to a blood or breathalyzer test which comes back positive, you will look like a liar.
2) Do not state that you have had anything to drink. A recent case in Tennessee has allowed police to make a DUI arrest solely on the admission of drinking by the suspect.
If an officer is going to arrest you on suspicion of DUI, there is nothing you can do to prevent it. Should this happen to you, simply give your name and address and tell the officer you want to answer questions only in the presence of your attorney.
