Should Every Moment Of A DUI Arrest Be Recorded?
With the presence of body cams and dash cams. there is a new call for every
moment of a DUI arrest to be recorded. In states like South
Carolina, judges have begun throwing out DUI charges against defendants
where the police did not record the entire arrest. Why is this the case?
Because the cams are always and should always be available.
The logic is that if an officer does not record the entire arrest, he or
she may have a reason for hiding the footage. The officer may be biased
or may feel that he or she needs to be proven correct in their
assessment of the driver's status of intoxication. In fact, in one
instance the dash cam was pointed backwards and the judge simply threw
out the charges, dismissing them.
Prosecutors, of course, want to rely on whatever evidence officers bring
and are against mandating the use of DUI arrest recordings while a defense
