One Drug Sale Can Result In Two Charges
A recent Florida case brought up the possibility that a single sale of
drugs can result in more than one criminal charge. How is this possible?
Because there were two drugs!
In an experimental case, a prosecutor in Florida has been allowed to
charge a man with two separate crimes stemming from a single drug sale.
A man sold heroin to an undercover officer and was arrested for selling
the drug, which is a class 2 felony. The drug was sent to a lab to
confirm that it was indeed heroin, which it was. However, the substance
also tested positive for fentanyl.
In an extraordinary move, the prosecutor then proceeded to charge the
man with a second class 2 felony - selling the drug fentanyl. As our
society becomes increasingly intolerant of the opioid epidemic,
prosecutors and wanting very much to send a strong message - do not sell
drugs or you will pay!
Of course, never partake in the sale or use of any illicit substances.
