Is A DUI Checkpoint Entrapment?
This is a question that is often asked and it is a good question. When police
officers set up a DUI checkpoint they are indeed looking for
intoxicated drivers. One could argue that they are setting you up and
are \"entrapping\" you into committing the crime of DUI.
The fact is, DUI checkpoints are not entrapment and the reason for them
not being so is very clear. Entrapment involves \"the conception and
planning of an offense by an officer...\" So, in reality, the officers at
a checkpoint are not conceiving of a crime or planning for a specific
individual to commit a crime. They are checking the ability of people
driving on a public way to legally operate a vehicle.
Never operate a vehicle under the influence of any substance and always
