In Virginia, A Defense Attorney Uses Lucidity Argument to Acquit Client
It was one in the morning and a Virginia driver was pulled over for not maintaining
his lane. He did a walk and turn and a one leg stand
(remember, you don't have to do these field sobriety tests, you can say
no!). The officer claimed that he failed them and arrested him on
suspicion of DUI.
As part of the one leg stand, the attorney noted that his client had
counted clearly, accurately and with a distinct unimpaired voice which
should not have made the "wobbly" walk he took enough evidence to arrest
him, as most people would likely be "wobbly" coming home at one in the
morning. The judge agreed and acquitted his client.
