Even Without Sobriety Tests, Juries Are Increasingly Likely To Convict
There was a case in California recently where a driver was charged with DUI, apparently operating under the influence of Meth. The perpetrator was so vocal and unruly (shouting after the incident, which left a cyclist paralyzed) that she was immediately taken into custody and no sobriety tests were conducted.
At the hospital, a bag of Meth was discovered on her person. She claimed at trial that the she did not have enough Meth in her system to impair her and that the road she drove the wrong way down (it was a one way road) was not clearly marked. The jury didn't buy it and convicted her on all counts against her.
