Claiming A "Medical Issue" To Avoid Arrest Could Mean Trouble
Some people are so terrified of being locked up in a jail cell, for any
length of time, they will either actually have a panic attack and
request to be taken to the hospital, or they will \"fake\" having a heart
or another serious issue requiring law enforcement to take them to the
hospital.
It is true that all emergency personnel must take anyone complaining of
potentially life-threatening symptoms to a medical center (usually a
hospital) for treatment and evaluation. This does, indeed, keep that
individual from being immediately taken to jail. However, it usually
only delays the inevitable for a few hours.
One legal complication that can arise from an emergency room visit while
under arrest is that the hospital may draw blood to run tests. If you
have been arrested for DUI or any crime that may involve drug use, you
run the risk of having the results of that bloodwork being used in court
against you. Different states have different laws about how medical
records can be used, so different outcomes across the nation will arise
from medical records requests.
