California Pushes for Saliva Test
With the legalization of recreational marijuana in many states, California is among the first to propose testing drivers’ saliva for the presence of marijuana use – and the use of many other substances. The main issue with the test is that there are no current standards for determining impairment due to marijuana use or other substances.
Alcohol has a clearly defined blood concentration to ascertain if a driver is impaired and driving under its influence. However, marijuana and other substances do not have clearly defined limits to legally determine whether or not one is under their influence.
Assembly Bill 6 will be up for vote early next year where the major debate will be whether or not laws like these should even be considered until standards of impairment for substances other than alcohol have been determined.
