Always Question the Credibility of Witnesses Against You
An interesting event happened recently in Wake County, North Carolina. North Carolina law allows for anyone asked to take a breathalyzer test to have a third party of their choosing present during the administering of the test. One woman testified that she was now allowed to contact anyone and therefore was denied this right. The arresting officer, a deputy, testified that she had been allowed to contact someone but chose not to do so.
Fortunately for the defense the room in which breathalyzers are performed has recording equipment - which was running at the time of the lady's request. In fact, she was not offered the option to call someone and it was documented on the tape. What was the result? 104 DUI cases involving that deputy were all thrown out by the judge since he lied on the witness stand.
Always question anyone who testifies against you, especially if they are doing so falsely.
