Window Tint And Traffic Stops

Your window tint may be cause for you to be stopped by a patrol officer. If in the course of that stop, he believes and/or finds that you are intoxicated you will be charged with a DUI.

There have been a few cases recently where the defense argued that since their clients' window tint wasn't actually illegal, the stop for the tint resulting in the DUI charge was itself illegal. This claim worked its way up the court of appeals and what the justices determined was that the burden of "legal tint" was not up to the officer to determine. Instead, if the officer deems it "reasonable" to think the tint is illegal, then the stop is, therefore, a legal stop.
