Can A DUI Become A Felony?

In some states, a DUI charge can result in a felony conviction. For instance, in California, if you have three DUI-related conviction within the past 10 years, the new charge becomes a felony. There are some other circumstances where a DUI charge can become a felony. Most of these are DUIs which involved some type of injury. If you injure someone while driving drunk, you will be charged with a major crime.

Of course, if a death is involved then a DUI charge can also include charges such as manslaughter or vehicular homicide. Interestingly, if you have any felony DUI charges in the past ten years in California, any new DUI charge becomes a felony charge.
