Let's say you are driving on the Interstate and you notice a car weaving in and out of its lane, or driving well under the speed limit and you pass the driver who you notice has glassy eyes. Can or should you have someone in your car call it in?

If someone does call it in this is what is known as an anonymous tip and the police can act on it, even if the police have not witnessed the drunk driving activity themselves. In 2014 the Supreme Court ruled in Navarette v California that law enforcement may act on an anonymous tip regarding a potential drunk driver citing the harm that drunk drivers can cause.

What the court determined was that if an anonymous tip has "sufficient indicia of reliability," then an officer does not need to directly observe the suspicious DUI behavior and can proceed to investigate.
