If Someone Says I Was Drunk Driving, Can I Be Prosecuted?

This is a question that some people ask. They say, what if someone at a party thinks I was drunk when I left and tells a friend who then tells the authorities that I was drunk driving? Will I then be arrested and charged with a crime?

This brings up the issue of Hearsay. This may be confusing to some people but we can simplify it a bit for you. Hearsay is basically someone saying something that they heard someone else says. For example, Person X states that they heard from Person Z that Person Y drove drunk. That would be hearsay. Person X stating that they saw Person Y drink eight beers in two hours and drive would be an eyewitness account.

Eyewitness testimony is, of course, allowed in court while hearsay usually is not. You need an attorney who will question all evidence against you and defend you aggressively.
